Terms of Service

Rules for using MagnusOP as a trader or store operator.

These Terms of Service ("Terms") govern your use of MagnusOP and related services (the "Platform"). By creating an account or using the Platform, you agree to these Terms and our Privacy Statement, which explains how we handle personal data under Nigeria Data Protection Act (NDPA) 2023.

Acceptance

You must be at least 18 years old and able to form a binding contract. If you use the Platform on behalf of a business, you confirm you have authority to bind that business. Continued use after we post updated Terms constitutes acceptance where permitted by law.

The service

MagnusOP is a business operating system for traders: inventory, sales, reports, customer records, optional online stores, and assistive AI features. We may add, change, or remove features. The Platform is provided on an "as available" basis; we do not guarantee uninterrupted access.

Accounts & security

  • You are responsible for your login credentials and all activity under your account.
  • Use a strong password and enable two-factor authentication where offered.
  • Notify us promptly at support@magnusop.com if you suspect unauthorized access.
  • We may suspend accounts that violate these Terms or pose a security risk.

Acceptable use

You agree not to:

  • Use the Platform for unlawful purposes or in violation of Nigeria Data Protection Act (NDPA) 2023.
  • Upload malware, scrape the service abusively, or attempt to bypass security or rate limits.
  • Access another trader's data without authorization.
  • Send spam, bulk unsolicited messages, or sell customer contact lists collected via the Platform.
  • Misrepresent your business, products, or prices on a public store.
  • Use AI features to generate harmful, fraudulent, or illegal content.

Traders are data controllers for customer phone numbers and CRM data they enter. You must obtain lawful consent before marketing and honor deletion requests from your customers.

Subscriptions & access

  • Some features require an active subscription or approved access status.
  • Pricing, tiers, and included features are shown in the app or communicated at signup.
  • We may offer trials or promotional access; terms for those offers apply at the time they are granted.
  • Failure to pay applicable fees may result in restricted access until payment is resolved.

Payments & refunds

  • Platform fees and store checkout may be processed via third-party payment providers (e.g. Paystack).
  • Traders are responsible for configuring their own payment keys and complying with payment-provider rules.
  • Refunds for platform subscription fees are handled case-by-case; contact support within 7 days of a mistaken charge with details.
  • Refunds for end-customer store purchases are between the shopper and the trader; MagnusOP facilitates checkout but does not guarantee trader fulfillment policies.

Online stores

  • Traders control store content, pricing, discounts, and fulfillment.
  • Product limits and premium features may apply based on your plan.
  • We may unpublish stores that violate these Terms, applicable law, or create fraud or abuse risk.

Your data & intellectual property

  • You retain ownership of business data you enter (products, sales, customers, etc.).
  • You grant us a limited license to host, process, and display that data solely to operate the Platform.
  • You may export your data from Settings; see our Privacy Statement for deletion rights.
  • MagnusOP branding, software, and templates remain our intellectual property.

Account termination

You may stop using the Platform at any time. To delete your trader account and associated data, follow the process in our Privacy Statement or email support@magnusop.com. We may terminate or suspend access for breach of these Terms, non-payment, or legal requirement. Some records (e.g. payment references) may be retained as required by law.

Disclaimers

The Platform is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. Business decisions you make using reports, AI suggestions, or inventory data are your responsibility. AI output may be inaccurate; verify important figures before acting.

Limitation of liability

To the maximum extent permitted by Nigerian law, MagnusOP and its operators are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Platform is limited to the fees you paid us in the twelve (12) months before the claim, or ₦50,000, whichever is greater, except where liability cannot be limited by law.

Governing law & disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes should first be raised with support@magnusop.com. If unresolved, parties may pursue remedies in a court of competent jurisdiction in Nigeria.
